Within 10 business days after the Initial Contract Year, agree the Delivered Value; after 30 days without agreement, a Valuation Expert decides. Shortfall is treated as an unavailable Asset; excess rolls into Contract Year 2.
Term extensionAmd. §5
Term extended by one Contract Year to nine; the last Contract Year expires Mar 31, 2029.
Sole remedy for COVID-19Amd. §6
For the Initial Contract Year only, the Amendment is the Sponsor's sole remedy for non-delivery due to COVID-19.
